Baker has scheduled a 1:30 p.m. sentencing hearing for Lackey in his courtroom. A seven-woman, five-man jury convicted Lackey of capital murder earlier this month for the 2005 Halloween night killing of 80-year-old Charlie Newman. The jury recommended death for Lackey. The jury found Lackey guilty on two counts of capital murder. The four-count indictment charged Lackey with capital murder during a burglary, capital murder during a robbery, burglary and robbery. Baker must decide if Lackey will be sentenced to death by lethal injection or to spend the rest of his life in prison without the possibility of parole. Defense attorney Randy Gladden of Huntsville put both of Lackey’s parents, father Michael Lackey and mother Sharon Lackey, on the stand to show that he had been a troubled child. Both pleaded for their son’s life. But Limestone County District Attorney Kristi Valls said that Lackey was acting under the notion that Newman, a former building contractor, had a vault built into a room under his stairwell in which he kept large supplies of cash and gold bars. She said Lackey came to Newman’s home that night to rob him and kill him. Newman was stabbed numerous times and was shot with his own gun, a gun that police said Lackey took from Newman who was attempting to use it to protect himself. Newman lived just off North Hine Street in Athens.
