— An Athens man has been formally charged with first-degree sodomy for allegedly having oral and anal sex with an underage boy.

Stephen Warren Usery Jr., 40, of 21741 Rochelle Road, Lot 3, was among 128 people indicted by a Limestone County grand jury in October and released Thursday by Limestone County Circuit Clerk Charles Page Jr. The clerk’s official typically releases the names after the grand jury hands down its indictments to give law-enforcement officials time to arrest them on the formal charges.

Usery was initially charged with first-degree sodomy in June.

Sheriff Mike Blakely said at the time of Usery’s initial arrest a school counselor contacted his department about the matter and an investigation followed.

To protect the identity of the victim, the sheriff declined to disclose the connection between the victim and the accused. However, the sheriff did say the alleged abuse occurred over several years.

First-degree sodomy is a Class A felony punishable, upon conviction, by a sentence of 10 to 99 years in prison.
