Man held without bond on sex offender charges

An Athens man remains held without bail in the Limestone County Jail after allegedly violating the state sex offender act.

Limestone County Sheriff’s Deputy Steve Rogers arrested Dale Alan McClendon, 38, of 15278 Alabama 251 on the charge Tuesday afternoon, records show. No bail was set because he McClendon, who is a registered sex offender, cannot be released until he meets the requirements of the act.

McClendon had to first register as a sex offender in June 2012 following his conviction for second-degree strong-arm rape, which occurred in Limestone County, state records show. (No records about the age or sex of the victim were immediately available.)

Under the sex offender act, offenders must report four times per year, in person. However, McClendon refused to return and supply information for one year, records show.

Investigator Mike Gunter, who monitors the more than 100 registered sex offenders in Limestone County, discovered McClendon’s lapse in registration and obtained the arrest warrant, records show.

Under the Alabama Code, a person commits the crime of second-degree rape if he or she, being 16 years or older, engages in sexual intercourse with a member of the opposite sex who is more than 12 but under 16, provided the actor is at least two years older than the member of the opposite sex. Or, he or she engages in sexual intercourse with a member of the opposite sex who is incapable of consent by reason of mental defect.
