Menefee to ADEM: ‘We will have a plan in place this week’

ADEM gives county until June 28 to submit debris removal plan

ATHENS — The Alabama Department of Environmental Management is giving the Limestone County Commission 30 days to submit a removal plan for what the agency describes as “unauthorized debris” taken from the county’s L&S property to farmland on Leggtown Road.

Commission Chairman Stanley Menefee said Tuesday the county must obtain ADEM’s permission for its plan before removing the debris.

“We will have a plan in place this week to resolve any issues ADEM may have,” Menefee said in a prepared statement.

Once the removal is authorized, the county will have 30 days to complete the process and submit proof of proper disposal.

ADEM has cited the county with at least three violations — taking debris to an illegal dump site, failing to provide notice about removing a commercial building and not having an environmental inspection conducted for the L&S property prior to demolition.

County workers transported the rubble from L&S in late April to farmland at 26679 Leggtown Road. The land, which is in District 4, is rented by Johnny Abernathy and owned by Terry Clemmons, according to ADEM documents.

In a letter to Abernathy, ADEM inspector Scott Gravette described the debris as being “illegally burned” and including insulation, treated or painted wood, clean wood and metal.

Abernathy requested concrete blocks from the L&S debris, according to District 3 Commissioner Bill Latimer, who has overseen the L&S demolition since January 2013.

Previous county commissioners Bill Daws and Gerald Barksdale and current commissioners Latimer and Gary Daly approved purchasing the L&S property for $525,000 in May 2012.
