UPDATED: Athens man indicted on rape, sexual abuse

ATHENS — An Athens man has been formally charged on five counts of rape and sexual abuse dating back to 2007 and 2011.

Limestone County Sheriff’s deputies arrested Austin Smith Clem, 24, of 24123 Black Road, on one count of first-degree rape, two counts of second-degree rape and two counts of second-degree sexual abuse following his indictment in October by a Limestone County grand jury.

Clem is accused of having sex and sexual contact with a female acquaintance when she was over age 12 but under 16, which resulted in the charges of second-degree rape and second-degree sexual abuse," Limestone County District Attorney Brian Jones said. Clem is also accused of having forcible sex with the same female acquaintance several years later when she was over age 16, which resulted in the first-degree rape charge, Jones said.

The indictment came following an investigation by Athens Police Department in 2011.

Clem is accused of committing offenses on two separate occasions in 2011 and in 2007.

He was released from the Limestone County Jail Tuesday after posting bail of $65,000, records show.
