BREAKING: Athens man jailed for sex abuse now facing sodomy charge

An Athens man arrested last week on charges of sexual abuse is now facing an additional charge of sodomy.

Limestone County Sheriff’s Investigator Leslie Ramsey has arrested John Wayne Kelley II, 45, of 109 Fifth Ave., on a charge of second-degree sodomy in connection with an alleged incident in Limestone County, Chief Deputy Capt. Stanley McNatt said.

Kelley was already in the Limestone County Jail facing two counts of first-degree sexual abuse in connection with a 13-year-old girl. Athens Police had arrested him on those charges June 12 after receiving reports about incidents involving the girl, who is related to Kelley. Both incidents allegedly occurred June 11 at different times in the area of Fifth Avenue and the train tracks, police said.

“As a result of that investigation and following an interview with the victim, we determined an incident of sodomy occurred in the county,” McNatt said.

The Athens-Limestone Child Advocacy Center is assisting with the case.

Under Alabama law, first-degree sexual abuse — a Class C felony — is defined as sexual contact by forcible compulsion.

Under state law, second-degree sodomy — a Class B felony — occurs when a male, being age 16 or older, engages in deviate sexual intercourse with a person under 16 and over 12 or with a person incapable of consent by reason of mental defective.
