Deployed trooper’s trial to be delayed at least a year

— The trial of an Alabama state trooper accused of causing the fatal wreck that killed a Tanner couple in 2011 will be postponed because the law-enforcement officer has been deployed overseas.

James Heath Moss, 31, of Athens, a Navy reservist, was called up April 15 for eventual deployment overseas, court records show. Moss’s attorney, James Wooley of Birmingham, filed a motion April 24 asking the court to postpone the trial.

A letter from the military to Moss, which was included in the defense’s request for postponement, read, in part, “You are hereby involuntarily ordered to report for active duty … for a period of 365 days unless released sooner by the order of the issuing authority…”

Limestone County District Attorney Brian Jones did not object to the postponement, records show.

Moss was scheduled for trial April 29 in Limestone County Circuit Court.

He is charged with two counts of criminally negligent homicide in the April 25, 2011, wreck that killed Jamie Lee Gossett, 31, and Sarah Rene Gossett, 38, of Tanner.
