Judge hears bid to close abortion operation

— BIRMINGHAM, Ala. (AP) — A judge is considering the state's attempt to close what health regulators say is an unlicensed abortion clinic in Birmingham.

A Jefferson County judge has scheduled a hearing for Monday on a bid to shut down the facility that was known for years as New Woman All Women Health Care.

Health officials cited the clinic for dozens of health violations last year and the operators agreed to close. But a doctor is still performing abortions at the site.

Former New Woman clinic operator Diane Derzis says a doctor is now performing abortions in the facility and paying her rent. She says she has nothing else to do with the office.

State attorneys say the facility is operating as an illegal abortion clinic because it doesn't have a license.
