AUBURN, Ala. (AP) The lawyer for an Alabama man accused of poisoning the famed Toomer's Corner oak trees at Auburn University says he will attempt to reach a plea deal with prosecutors.
Harvey Updyke Jr. is scheduled to appear Wednesday in U.S. District Court.
His attorney, Glennon Threatt Jr., told WBRC-TV of Birmingham that he will try to reach a plea deal with prosecutors to avoid possible jail time for his client.
Updyke faces charges of criminal mischief after authorities said he used herbicide to poison the trees.
